		<description>FMLA has requirements for employees just like it has requirements for employers, one of those is that the employee must have worked for the employer for at least one year.  Because you have only worked for 4 months they aren&#039;t bound by FMLA, depending on your state there may be other types of leave you could benefit from.  I suggest you check with your local DOL or an employment attorney for more information.</description>

		<description>I have a ?. I was hurt on the job due to an unjury. I was out from 9/1-1/3 when plant reopened. During that time i found out that i need a breast biopsy. I was scheduled to have surgery in 3/11 but office had me to push procedure up to 2/11. After this was setup I was told by office that I only had 9 weeks left of FMLa. I didnt think that FMLA and W/C worked hand and hand. And also when doctor released me from physical therapy which I didnt have surgery they put me back on the same job and i have not complained but the from the postion they have put mee back in I have being hurting again I have ask my supervisor about moing me someone else on the lines where I wouldnt have to do any heavy lifting but I am still there. I have reported numerous of time to HR the lady said that she will have him move me but this has not happen. I know that I am not the only one that can lift these 10lds. I lift approximately 48 totes a day with no help. And my shoulder is hurting worses now. I just want to know what my options are here. i am in the state of MS. i need help to these ? on if these 2 work hand and hand. And what should I try to do to resolve this. I try not to complain and continue to work in pain and take pills to relieve the pain . I have a doctors appt on the 23rd of this mont</description>

		<description>I have only worked with this company for 4 motnhs, 40 hours a week and I have a serious condition that I need to have surgery.  I went to tell my supervisor on the day that I found out, which was 11-17-10 that they have scheduled me for surgery for 12-8-10 and that I would only try to take 2 weeks off. She informed me that she didn&#039;t think that she could cover my position for the surgery and that she was sorry.  She said she would see what she could do, but I would probably need to reshedule when she could find someone to cover me.  Is that legal?</description>

The Fair Labor Standards Act covers overtime regulations, you should search further into that.  It states that overtime is based on a 7 day work week, with some states having daily overtime if you work more than a certain number of hours.
Some employers don&#039;t count time off of less than a week as FMLA.</description>
