    I have only worked with this company for 4 motnhs, 40 hours a week and I have a serious condition that I need to have surgery. I went to tell my supervisor on the day that I found out, which was 11-17-10 that they have scheduled me for surgery for 12-8-10 and that I would only try to take 2 weeks off. She informed me that she didn’t think that she could cover my position for the surgery and that she was sorry. She said she would see what she could do, but I would probably need to reshedule when she could find someone to cover me. Is that legal?

    Just wanted to know if you can be fired for being on fmla and being in public with family or by yourself i have a friend that was fired from their job for being on fmla and was out in public with family at his little boys birthday party i dont think he should of gotten fired for it but he did?

    There are lots of things that go into terminating an employee, the employer may have felt that if he was able to attend a birthday party he should have been able to come to work. There might have been a violation in rights, your friend might want to have his situation reviewed by an employment attorney.

    FMLA has requirements for employees just like it has requirements for employers, one of those is that the employee must have worked for the employer for at least one year. Because you have only worked for 4 months they aren’t bound by FMLA, depending on your state there may be other types of leave you could benefit from. I suggest you check with your local DOL or an employment attorney for more information.

    received letter of warning for calling in fmla on my scheduled off day is this legal?
