		<description>FMLA has requirements for employees just like it has requirements for employers, one of those is that the employee must have worked for the employer for at least one year.  Because you have only worked for 4 months they aren&#039;t bound by FMLA, depending on your state there may be other types of leave you could benefit from.  I suggest you check with your local DOL or an employment attorney for more information.</description>

		<description>I have only worked with this company for 4 motnhs, 40 hours a week and I have a serious condition that I need to have surgery.  I went to tell my supervisor on the day that I found out, which was 11-17-10 that they have scheduled me for surgery for 12-8-10 and that I would only try to take 2 weeks off. She informed me that she didn&#039;t think that she could cover my position for the surgery and that she was sorry.  She said she would see what she could do, but I would probably need to reshedule when she could find someone to cover me.  Is that legal?</description>
