FMLA has certain requirements that both the employee and the employer need to meet to be eligible for leave, for the employee, they must have worked with the employer for 12 months or more and work a minimum 1250 hours in the past 12 months of employment.  For the employer, they must maintain 50 or more employees in a consecutive 20 week period of the current or preceding year.
