When to call an Attorney.

One question that I frequently get asked is “When should I seek legal advice?”


I started FMLA-Rules.com as a source for the common person to get free advice about their questions regarding the Family Medical Leave Act. My experience in Human Resources gave me the opportunity to provide that input to those in need. I am not an attorney and whenever I have a client ask that question I always tell them the same thing, “Whenever you feel you have been mistreated, go talk to your lawyer and see what they think.” Which is usually followed by, “can you recommend someone?”
The Family Medical Leave Act was enabled to restore rights to those individuals who needed to take time for their own serious medical conditions or those of a close family member, and that’s what it’s there for, so if you feel that you are being mistreated because of you are requesting FMLA or are out on FMLA consult with your legal council, if they feel you case has merit they will tell you.

As for the second part, due to the nation wide publicity that FMLA-Rules.com gets it would be difficult for me to recommend any one firm that would help, especially someone in your area, though recently I was checking out the legal match web site, they offer you help finding a lawyer in your area for free, and for me, free is the right price. When you are on your search for someone just be sure to find someone who specializes in employment law, they will have the best knowledge of the rules and regulations about FMLA and can best represent you for employment law.

    Ive been with mu company for almost two years and to protect myself I have a 2 children with an illness and decided to get FMLA..every since then my team leader has been lying on me making false claims and trying to paint a negative picture of my work in emails. when I ask her about my quality and production says everything is good just come to work! After the 2ND false accusation I notified my supervisor how i felt uncomfortable and that she was harassing me he said he would talk to her and suggested that I switch team leads.. after thinking how this would reflect to the dept and my review as to working with others I felt like I was being punished and I had no problem working with her. Weeks later she made another false accusation and in error forwarded an email to me meant for my supervisor that disrespected me and depicted me as a liar. I was scared because I thought if he had talked to her why would she comfortable talking in that tone to him. The email also suggested %#@!@## we all know what that means…I went directly to him and expresed my thoughts, concerns and advised that this provided me proof of what I thought she was trying to do but I felt atimadted by under whoes direction?? So I followed up with our local hr rep she I advised her of the issue and she was in agreement that it was inapproriate and she would follow up with him. Shortly after he talked her she told others on staff. The followin day our supervisor was out of the office and I was approached in the manner that I did something wrong I showed the email containg my reply to he false aqcusation and a breakdown of what I had on my desk and the fact she included the next day work in her figures. She was leaning over my shoulder and reported me to my supervisor. He changed his tone and talked to me in a firm voice I never heard him speak. It was scary and atimdating. He advid=sed he thought we werwe clear on the issue and he was advised that I showed the email and may cause a split in the department. I said that i did show the email and was confirming the way I reported my work was in line with the department. He said he didnt want this to go any further but I already scheduled a call with HR in our main headquarters I wanted to advised them that I felt harrassed. To bring this full circle I was advised that she checked my desk and went thru my draweres where in the almost two years I nNEVER keep work there everything is in reach. My teamlead went thru my personal paperwork and came across my fmla paperork and my childrens medical file that I faxed in December and abused them and shared with others this was witnessed that the other teamlead told my teamlead to “put them back its not approprate” I just was advised of this.I am afraid this will escalate withinn 72 hour I will report this to HR in the main corporate office.     This is a perfect example of, when should I contact an attorney. Keep in mind that no lawyer would make ANY money if they charged people to ask questions, it’s the best way they have to screen cases before they get to the point that they are comfortable to say “I will represent you in this case.”
